Please read these Terms and Conditions ("Terms") carefully before using the GetDiscount platform. By creating an account or accessing any part of the service, you agree to be bound by these Terms.

1. Eligibility

To use GetDiscount, you must:

• Be at least 13 years old
• Have the legal capacity to enter into a binding agreement
• Reside in a country where the platform is available (EU, UK, Ukraine)

Users under the digital age of consent in their country (13–16 depending on jurisdiction) may require parental or guardian consent for certain data processing activities as described in our Privacy Policy.

If you do not meet these requirements, you must not use the platform.

2. Description of the Service

GetDiscount is a SaaS loyalty platform that enables Users to:

• Discover and join loyalty programs offered by participating Merchants
• Earn, track, and redeem rewards, coupons, and personal discounts
• Store third-party loyalty cards in a local digital e-wallet
• Track visit history, reward progress, and coupon expiration
• Explore businesses through intelligent search and location-based recommendations

For Merchants, the platform provides tools to:

• Create or import business profiles
• Configure loyalty programs and promotional offers
• Manage store networks and assign managers
• Validate customer visits via QR codes
• Access analytics and insights into customer engagement

GetDiscount acts solely as a technical facilitator and does not operate or control Merchant programs.

3. User Accounts

3.1 Registration

You must provide accurate and complete information during registration.

Required fields may include:

• Email address
• Phone number (for Business Owners or certain reward tiers)

3.2 Account Security

You are responsible for:

• Keeping your login credentials confidential
• All activity occurring under your account

GetDiscount is not liable for unauthorized access resulting from your failure to secure your account.

3.3 Unique Identifier

A unique User ID is assigned to your profile to track your participation across the loyalty network.

4. Loyalty Programs & Rewards

4.1 Merchant Responsibility

All loyalty programs, discounts, and rewards are created and managed by Merchants.

GetDiscount:

• Does not guarantee the availability, accuracy, or continuity of any Merchant program
• Is not responsible for a Merchant's refusal to honor a reward
• Is not liable for changes, errors, or termination of Merchant programs

4.2 No Cash Value

Unless explicitly stated by the Merchant:

• Points, rewards, and coupons have no monetary value
• They cannot be exchanged for cash or transferred to other users

4.3 Expiration & Tracking

Users are responsible for monitoring expiration dates and usage limits displayed in the app.

5. E-Wallet & Local Storage

5.1 Local Storage

The GetDiscount E-Wallet allows you to store photos or screenshots of third-party loyalty cards.

These images are stored locally on your device, not on GetDiscount servers.

5.2 Loss of Data

If you:

• Delete the app
• Reset your device
• Clear your cache
• Lose your device

…your stored e-wallet images may be permanently lost. GetDiscount does not back up or restore these images.

5.3 Rights to Uploaded Content

By uploading third-party cards, you confirm that:

• You have the legal right to digitize and store those cards
• You are not violating any third-party terms or intellectual property rights

6. Location-Based Services

To display nearby offers, the platform may request access to your device's geolocation. You may enable or disable this at any time in your device settings.

Accuracy of location data depends on your device, GPS, and network provider.

7. Prohibited Conduct

You agree not to:

• Engage in fraudulent activity (e.g., multiple accounts to exploit rewards)
• Manipulate QR codes, reward validation, or visit tracking
• Reverse engineer, decompile, or attempt to extract source code
• Upload offensive, illegal, or infringing content
• Interfere with platform security or attempt unauthorized access

Violation of these rules will result in immediate account termination.

7a. Content Policy & Abusive Behaviour

GetDiscount has zero tolerance for objectionable content or abusive users.

The following are strictly prohibited:

• Posting, transmitting, or sharing content that is offensive, hateful, defamatory, or illegal
• Harassing, threatening, or abusing other users or GetDiscount staff
• Submitting false business reviews, fake reward redemptions, or misleading content
• Any conduct that violates applicable law or the rights of others

Users found to be posting objectionable content or engaging in abusive behaviour will be removed from the platform within 24 hours of detection or report. To report objectionable content or abusive behaviour, contact us at: support@getdiscount.app

8. Intellectual Property

All content, branding, software, and technology on the platform—including logos, UI elements, algorithms, and databases—are the exclusive property of GetDiscount or its licensors.

You may not:

• Copy
• Modify
• Distribute
• Sell
• Reproduce

…any part of the platform without prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, GetDiscount is not liable for:

• Indirect, incidental, punitive, or consequential damages
• Loss of data stored locally on your device
• Errors in Merchant program configuration or reward calculations
• Disputes, transactions, or interactions between you and a Merchant
• Service interruptions, bugs, or technical issues

Your sole remedy for dissatisfaction with the platform is to discontinue use.

10. Merchant-Specific Terms (For Business Owners)

Merchants agree to:

• Provide accurate business information
• Honor rewards and offers according to their own program rules
• Comply with applicable consumer protection and privacy laws
• Use customer data only for loyalty-related purposes
• Ensure staff follow proper validation procedures

GetDiscount may suspend Merchant accounts for misuse or fraudulent activity.

11. Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or abusive behavior
• Required information is found to be inaccurate
• We are required to do so by law or regulatory authorities

Upon termination, access to your rewards and account data may be permanently lost.

12. Modifications to Terms

GetDiscount may update these Terms at any time.

Significant changes will be communicated via:

• Email
• In-app notifications
• Website announcements

Continued use of the platform after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which GetDiscount is legally registered, without regard to conflict-of-law principles.

Any disputes shall be resolved in the competent courts of that jurisdiction.
